General Provisions

These terms define the rules for using the PsychoSpace platform. The service aims to connect patients with certified therapists using advanced matching algorithms.

Definitions

User - any individual using the Service. Specialist - certified therapist providing services via the platform. AI Matching - proprietary scoring and matching system.

Rules of Use

Users are required to provide true data in the matching process. The platform does not replace professional medical help in life-threatening situations (see: Crisis Support).

Privacy and Personal Data

All data are processed in accordance with GDPR and HIPAA standards. PsychoSpace uses end-to-end encryption for video sessions and peak standards for medical documentation protection.

Payments and Bookings

Booking a visit occurs after the terminal is accepted by the Specialist. Payments are handled by a secure third-party operator. Details regarding refunds are in the Cancellation Policy.

Account Registration and Security

Users are responsible for maintaining the confidentiality of their account credentials. You agree to notify us immediately of any unauthorized use of your account. PsychoSpace provides multi-factor authentication (MFA) for therapists and end-to-end encryption for journal entries. It is the user's responsibility to enable and maintain these security features.

GDPR Compliance and Data Protection

PsychoSpace complies with the General Data Protection Regulation (GDPR). We act as the data controller for patient data and as a data processor for therapist-patient relationship data. Detailed information about data processing, retention periods, and your rights is available in our Privacy Policy. A Data Processing Agreement (DPA) is available for practitioners upon request.

User Conduct and Prohibited Activities

Users agree not to: (a) use the platform for any unlawful purpose; (b) impersonate any person or entity; (c) interfere with platform security features; (d) upload malicious code or content; (e) scrape, data-mine, or otherwise extract data from the platform without permission; (f) harass, abuse, or harm other users or therapists.

Intellectual Property

All content, design, code, logos, and branding on the PsychoSpace platform are the exclusive property of R-BIT Software Rafał Białek. Users retain ownership of content they create (journal entries, session notes). By using the platform, you grant PsychoSpace a limited license to process your content as necessary to provide the service.

Limitation of Liability

PsychoSpace provides a platform for matching patients with therapists and facilitating therapeutic communication tools. We are not a healthcare provider and do not provide therapy services. We are not liable for the quality, outcomes, or consequences of therapy sessions arranged through the platform. In case of a mental health emergency, users should contact emergency services immediately. PsychoSpace's total liability is limited to the amount paid by the user in the 12 months preceding the claim.

Cancellation and Refund Policy

Session bookings can be cancelled free of charge up to 24 hours before the scheduled session. Cancellations within 24 hours may be subject to a cancellation fee at the therapist's discretion. Refunds for cancelled sessions are processed within 14 business days. Disputes regarding cancellations or refunds should first be addressed with the therapist directly. If unresolved, contact iod@psychospace.io.

Termination

Either party may terminate the service agreement at any time. Users may delete their account through Settings > Privacy. Upon deletion request, a 30-day grace period applies, during which the deletion can be cancelled. After 30 days, all personal data is permanently deleted, subject to legal retention requirements (tax and medical documentation laws). PsychoSpace reserves the right to suspend or terminate accounts for violation of these terms.

Dispute Resolution

Any disputes arising from these terms shall first be attempted to be resolved amicably through direct communication. If unresolved within 30 days, disputes shall be submitted to the competent courts in Warsaw, Poland, under Polish law. Consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Changes to Terms

We may update these terms from time to time. Users will be notified of material changes via email. Continued use of the platform after changes constitute acceptance of the updated terms.
